FANTOM INDUSTRIES LLC WARRANTY STATEMENT
DISCLAIMER OF WARRANTIES
THE WARRANTIES AND REMEDIES CONTAINED HEREIN ARE EXCLUSIVE AND IN LIEU OF
ALL OTHER WARRANTIES EXPRESS OR IMPLIED OR STATUTORY, INCLUDING ANY LIABILITY
ARISING UNDER ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR
PURPOSE, STATUTORY OR OTHERWISE. THIS WARRANTY GIVES THE OWNER SPECIFIC LEGAL
RIGHTS, AND YOU MAY HAVE OTHER LEGAL RIGHTS, WHICH MAY VARY FROM STATE TO STATE
(OR BY COUNTRY OR PROVINCE). FANTOM INDUSTRIES LLC DOES NOT EXCLUDE, LIMIT OR
SUSPEND OTHER LEGAL RIGHTS YOU MAY HAVE UNDER THE LAWS OF YOUR STATE (OR
COUNTRY OR PROVINCE). FOR A FULL UNDERSTANDING OF YOUR RIGHTS, YOU SHOULD
CONSULT THE LAWS OF YOUR STATE, COUNTRY OR PROVINCE.
IN NO EVENT SHALL FANTOM INDUSTRIES LLC BE LIABLE FOR ANY INCIDENTAL,
SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES, WHETHER RESULTING FROM THE USE,
MISUSE OR INABILITY TO USE THIS PRODUCT OR FROM DEFECTS IN THIS PRODUCT.
Fantom Industries LLC retains the right to repair or replace the product
or offer a full refund of the purchase price minus merchant service fees at its
sole discretion. SUCH REMEDY SHALL BE THE CUSTOMER'S SOLE AND EXCLUSIVE REMEDY
FOR ANY BREACH OF WARRANTY. FANTOM INDUSTRIES LLC MAKES NO WARRANTY AS TO THE
ACCURACY OR COMPLETENESS OF DATA IN ANY PRODUCT SUBJECT TO THIS POLICY AND
DISCLAIMS ANY AND ALL EXPRESS, IMPLIED OR STATUTORY WARRANTIES, INCLUDING ANY
IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IT IS
THE USER'S RESPONSIBILITY TO USE ANY PRODUCT SUBJECT TO THIS POLICY PRUDENTLY.
ANY PRODUCT SUBJECT TO THIS POLICY IS INTENDED TO BE USED ONLY AS A TRAVEL AID
AND MUST NOT BE USED FOR ANY PURPOSE REQUIRING PRECISE MEASUREMENT OF
DIRECTION, DISTANCE, LOCATION OR TOPOGRAPHY.
This Policy supplements and is in addition to the consumer limited
warranty (the "Limited Warranty"). In the event of a conflict between
the terms of this Policy and the Limited Warranty, these terms will govern, but
solely with respect to marine products listed.
WARRANTY IS NON-TRANSFERABLE. IT EXTENDS ONLY TO THE ORIGINAL PURCHASER
AND THE ORIGINAL VESSEL ON WHICH THE PRODUCT WAS ORIGINALLY INSTALLED.
WARRANTY/PRODUCT REGISTRATION
The app, once installed and connected via Bluetooth to the Fantom system,
will register the system to the customer's phone number and name on our
internal app dashboard.
FANTOM INDUSTRIES LLC MARINE WARRANTY
Fantom Industries LLC offers one type of marine warranty for products.
Products not listed are covered by the Fantom Industries LLC One-Year Consumer
Limited Warranty.
Standard Marine Consumer &
Dealership Limited Warranty (Owner & Dealership Installation)
The warranty covers defects in materials/workmanship. Statutory rights
unaffected; this is sole remedy against Fantom Industries LLC, with no
liability for incidental/consequential damages absent contrary law.
Duration: 1 year from first customer purchase.
Coverage: Repair/replace (at Fantom Industries LLC option) failed
components in normal use. Free parts/device repair; customer pays for
transport/freight.
Exclusions: No onboard labor/travel reimbursement.
Eligibility: Factory-new products from approved dealer, installed by
Fantom Industries LLC-approved entity.
Proof Required: Original purchase invoice, Bluetooth ID from Fantom
system. Find this when you log into system with app. Example: Fantom 1-36 when
you connect to Bluetooth.
CLAIM PROCEDURE
- Contact Fantom Industries
LLC/certified entity within 30 days of failure - Troubleshoot with support
- Obtain RMA
- Submit complete online claim form
with proof of purchase/installation - Ship insured with proof of
purchase and visible RMA to provided address
Optional: Hire certified dealer at customer expense.
Incomplete claims may be delayed/denied.
WARRANTY EXCLUSIONS (ALL TYPES)
- Improper installation per manual
- Non-Fantom
parts/configurations/replacements/haul-outs - Shop supplies, lost time,
collateral damage - Damage from shipping, accident,
abuse, misuse, storage, alteration, unauthorized repair, corrosion, serial
tampering, power spikes, vandalism, water ingress/submersion - Force majeure (lightning, floods,
spills) - Maladjustment, poor maintenance
- Non-approved accessories or
non-intended use - Installation damage;
self-installed - Incorrect spec/install product
- RF interference, electrical
noise, stray voltage, chart errors, wrong voltage - Luxury updates, routine
checkouts/calibrations (unless per manual during repair) - No valid proof of
purchase/installation - Sea trials
- Damage to non-Fantom products on
autopilots/third-party connections - Freight to Fantom Industries LLC
- High-pressure water/chemical
damage - Digital switching:
design/redundancy/testing/cabling/use issues; no guidelines for all
scenarios
DISCLAIMER OF RESPONSIBILITY FOR COMPONENT AND SYSTEM
FAILURES
FANTOM INDUSTRIES LLC IS NOT RESPONSIBLE FOR ANY ELECTRONIC COMPONENT
FAILURES OR FANTOM SYSTEM FAILURES, WHETHER CAUSED BY MANUFACTURING DEFECTS,
ENVIRONMENTAL CONDITIONS, INSTALLATION ISSUES, POWER SURGES, ELECTRICAL
INTERFERENCE, WEAR AND TEAR, OR ANY OTHER CAUSE WHATSOEVER. THE CUSTOMER
ACKNOWLEDGES THAT ELECTRONIC COMPONENTS AND SYSTEMS MAY FAIL WITHOUT WARNING
AND ASSUMES ALL RISK ASSOCIATED WITH SUCH FAILURES.
FANTOM INDUSTRIES LLC SHALL NOT BE HELD LIABLE FOR ANY CONSEQUENCES,
DAMAGES, LOSSES, INJURIES, OR CLAIMS ARISING FROM OR RELATED TO THE FAILURE OF
ANY FANTOM INDUSTRIES LLC ELECTRONIC COMPONENT OR SYSTEM, INCLUDING BUT NOT
LIMITED TO: LOSS OF VESSEL CONTROL; NAVIGATION ERRORS; ELECTRICAL SYSTEM
DAMAGE; ENGINE DAMAGE; STRANDING; COLLISION; SINKING; FIRE; PERSONAL INJURY;
DEATH; OR ANY OTHER LOSS OR DAMAGE OF ANY KIND.
BY PURCHASING AND INSTALLING FANTOM INDUSTRIES LLC PRODUCTS, THE CUSTOMER
AGREES THAT FANTOM INDUSTRIES LLC'S SOLE OBLIGATION IN THE EVENT OF ANY PRODUCT
FAILURE IS LIMITED TO REPAIR, REPLACEMENT, OR REFUND OF THE PRODUCT AT FANTOM
INDUSTRIES LLC'S SOLE DISCRETION, AS SET FORTH IN THIS WARRANTY POLICY.
